And what of the regulator in all this? The Ofcom compliance challenges presented by generative AI are a regulator’s worst nightmare. Ofcom’s Broadcasting Code is a sophisticated document, built over years to handle issues of due impartiality, accuracy, and harm. But it was written for a world of human beings.
How does “due impartiality” apply to an entity whose “views” are a statistical composite of the data it was trained on? Who is the “broadcaster” responsible for the content when the presenter is a piece of software? These are not just philosophical questions; they are legal and regulatory time bombs.
