What Are We Even Legislating Here?

We are talking about creating accountable AI frameworks – a set of rules and responsibilities to ensure that the algorithms making decisions about our lives are fair, transparent, and don’t systematically discriminate against people.
Think of it this way: for decades, we’ve had rules for how humans in powerful positions—judges, loan officers, hiring managers—should behave to ensure fairness. AI is now taking on these roles, but without the built-in conscience or legal accountability. This legislation is an attempt to build that accountability into the code itself. It’s about making sure that when an AI says “no” to your loan application, there’s a good, fair reason why, and a way for you to challenge it.
The Problem With Biased Bots
Algorithmic bias is what happens when an AI system reflects the prejudices of the data it was trained on. It’s not that the AI is intentionally ‘racist’ or ‘sexist’. It’s just a very efficient pattern-matching machine. If you train a hiring algorithm on 30 years of data from a company that predominantly hired men for engineering roles, guess who the algorithm will think is the ‘ideal’ candidate for the next 30 years?
This isn’t a theoretical problem. When public sector bodies use these systems, the stakes are incredibly high. Flawed AI can lead to wrongful arrests, denied welfare benefits, or biased university admissions. Without robust India AI regulation, public trust in digital governance will evaporate. It’s one thing when Spotify gets your music taste wrong; it’s another entirely when a government AI wrongly flags you as a potential criminal.
India’s Bill: A Step in the Right Direction?
Enter the “Artificial Intelligence (Ethics and Accountability) Bill, 2025,” introduced by BJP MP Bharti Pardhi. According to a detailed report by MediaNama, the bill makes a direct attempt to tackle AI ethics legislation algorithmic bias. One of its key provisions is the mandate for developers to use diverse and representative training datasets.
This is a good start. The bill essentially tells developers they can’t just scrape the internet and hope for the best. They must actively work to ensure their data represents the population the AI will serve. The legislation also demands that any AI systems used in critical sectors like law enforcement, finance, and employment must be free of discrimination and can be withdrawn if significant bias is found.
The Dream of Transparency
A central pillar of the bill is transparency in public sector AI. It proposes that companies deploying AI must disclose the system’s purpose, capabilities, limitations, and the methodologies used to build it. This is a crucial move towards demystifying AI. It forces developers to show their working, moving these systems from inscrutable “black boxes” into something that can be audited and understood.
To enforce all of this, the bill suggests the creation of an AI Ethics Committee. This body would be responsible for developing ethical guidelines, conducting bias audits, and, importantly, serving as a grievance redressal mechanism for citizens harmed by AI decisions. It’s an ambitious plan to create a dedicated watchdog for the algorithmic age. But will it have the power and resources to be effective, or will it become another toothless regulator?
The Elephant-Sized Gaps in the Room
Here’s where the strategy starts to look a bit shaky. For all its focus on bias and transparency, the bill completely sidesteps the foundational issues of the AI economy: copyright, data ownership, and compensation.
AI models are trained on unimaginable amounts of data, much of it scraped from the public internet—news articles, artworks, personal blogs, public records. Yet, the bill, as MediaNama rightly points out, offers no framework for compensating the creators of this data. This is a massive legal and economic hole. You can’t build a sustainable and fair AI industry if you don’t have clear rules about who owns the raw materials and how they get paid for them. This omission makes the current draft of the India AI regulation feel incomplete.
Police, AI, and Vague Definitions
The bill does try to rein in the use of AI in surveillance by law enforcement, which is a welcome move. It suggests that police forces must get approval from the AI Ethics Committee before deploying systems like the MahaCrimeOS AI, reportedly used in over 1,100 police stations in Maharashtra, or Goa Police’s “Radical Content Analyser.”
However, it allows for their use for “lawful purposes”—a term so vague it’s practically an open invitation for misuse. Without a very strict definition of what constitutes a ‘lawful purpose’, this provision lacks the teeth needed to prevent these powerful tools from being used for mass surveillance or to target specific communities, exacerbating the very biases the bill aims to prevent.
Where Do We Go From Here?
This bill is a significant conversation starter. Its focus on AI ethics legislation algorithmic bias is exactly where the discussion needs to be. Mandating diverse datasets and creating accountable AI frameworks are necessary steps.
However, a house built on a faulty foundation will not stand. Future versions of this legislation must address the thorny economic questions of data ownership and copyright. Without a clear and fair compensation mechanism for the data that fuels AI, the entire ecosystem rests on a shaky, exploitative ground.
Furthermore, any framework for transparency in public sector AI must be backed by genuine enforcement powers and crystal-clear definitions, especially when it comes to law enforcement. Vague language is the enemy of good regulation.
India has an opportunity to create a comprehensive, forward-thinking regulatory framework. This bill is a first draft. Now, the real work begins: filling in the gaps and ensuring the final legislation is robust enough not just to guide the technology, but to protect the people it is meant to serve.
